Understanding Your H-1B Prevailing Wage Obligations

When an employer sponsors a foreign worker for an H-1B visa, the Department of Labor (DOL) mandates that the employer pay the "required wage." This required wage is the higher of either the actual wage paid to similarly employed individuals at the company or the prevailing wage for the occupation in the area of intended employment.

Establishing the correct prevailing wage is a critical compliance step. Employers generally have two options for determining this wage: relying on an employer-determined estimate or obtaining an official Prevailing Wage Determination from the DOL.

Option 1: Estimated Prevailing Wage
(Speed over Protection)

An estimated prevailing wage is determined by utilizing the DOL’s Occupational Employment Statistics wage library or another legitimate wage survey. This is the most common approach because it is instantaneous.

  • The Process: Match the job duties, education requirements, and experience levels to the government data to immediately identify the wage floor.

  • The Advantage: Immediate processing. You can proceed with filing the Labor Condition Application (LCA) and the H-1B petition without delay.

  • The Risk (Audit Liability): Relying on an estimate leaves the door open to government scrutiny. If the Wage and Hour Division (WHD) investigates the company, the government has the authority to challenge the occupational classification or the wage level the employer selected. If the government decides the wrong code or level was used, the employer may be liable for substantial back wages and civil penalties.

Option 2: Official Prevailing Wage Determination
(Safe Harbor)

To eliminate the audit risk associated with estimates, an employer can request an official Prevailing Wage Determination (PWD). This requires filing Form ETA-9141 with the National Prevailing Wage Center (NPWC).

  • The Process: We submit the detailed job requirements to the NPWC, and they issue a formal determination dictating the exact prevailing wage for the role.

  • The Advantage (Safe Harbor): When the NPWC issues a formal determination, it grants the employer "safe-harbor" status. If the WHD ever investigates the employer, the investigators are legally bound to accept the prevailing wage rate provided by the NPWC. They cannot challenge the wage rate, the occupational code, or the wage level.

  • The Risk (Time Delay): Procuring an official PWD currently takes several months. This significantly delays the filing of the H-1B petition and the onboarding of the worker.

The Business Decision: Time vs. Risk

The decision between an estimated wage and an official determination comes down to a strict business calculation. Employers must weigh their immediate need to onboard the worker against their long-term risk tolerance.

  • Choose the Estimate if: The hire is urgent and the company is willing to accept the potential compliance risk of a future WHD audit. (This is the most common choice given current PWD processing times).

  • Choose the Official PWD if: The company prioritizes absolute legal certainty and has a lead time of several months before the worker needs to begin employment.
